Welcome to Hasakura. This online store is operated by H.M.A. LTD (Х.М.А ЕООД), a company registered in Bulgaria and trading under the name Hasakura.

These Terms of Service govern your access to and use of hasakura.com and your purchase of products from our store. By accessing our website or placing an order, you agree to these Terms and the policies referenced below.

Hasakura is powered by Shopify, which provides the ecommerce infrastructure used to operate the store. Purchases made through this website are made directly from Hasakura. Hasakura, not Shopify or our fulfilment partners, is the seller responsible for products purchased from this store.

Nothing in these Terms limits any mandatory consumer rights granted under applicable law.

SECTION 1 – USE OF THE STORE

You may use the website only for lawful purposes. You must not use the store to commit fraud, infringe intellectual property rights, transmit malicious software, collect personal information unlawfully, interfere with the website or violate applicable laws.

You must provide accurate, current and complete information when creating an account or placing an order. You are responsible for protecting your account credentials and payment information.

We may suspend or restrict access where we reasonably believe that the website is being used fraudulently, unlawfully or in material violation of these Terms.

SECTION 2 – PRODUCTS

We make reasonable efforts to describe and display products accurately. Product colors and appearance may vary depending on screen settings, lighting, materials and production methods.

Minor differences in color, pattern placement, texture or appearance that result from the production process or screen display do not necessarily constitute a defect. This does not affect your rights if an item is defective, damaged or materially different from its description.

Some products are produced or fulfilled by production and logistics partners. Depending on the product, availability and delivery destination, orders may be shipped from different fulfilment locations. Hasakura remains responsible for products purchased through this store.

We may update product descriptions, discontinue products or limit available quantities when reasonably necessary and subject to applicable law.

SECTION 3 – ORDERS AND PAYMENT

Placing an order constitutes an offer to purchase the selected products. An order is accepted after payment has been successfully authorized and we send an order confirmation or begin processing the order.

We may decline or cancel an order for legitimate reasons, including product unavailability, payment failure, suspected fraud, pricing errors or delivery restrictions. If we cancel an order after collecting payment, the relevant amount will be refunded.

Please review your order carefully before submitting it. Once an order has entered production, fulfilment or processing, we may be unable to change or cancel it. This does not limit any mandatory cancellation or withdrawal right provided by applicable consumer law.

The final price, including taxes and charges collected by Hasakura, will be displayed at checkout before the order is submitted.

You confirm that you are authorized to use the payment method provided and that the billing and delivery information supplied is accurate.

SECTION 4 – SHIPPING AND DELIVERY

Hasakura provides free tracked standard shipping to destinations available at checkout.

Orders are generally prepared for shipment within 2–6 business days after payment is confirmed. Estimated delivery is 7–14 business days after shipment. The total estimated time from order placement to delivery is therefore approximately 9–20 business days.

Delivery times are estimates and may be affected by customs procedures, carrier delays, severe weather, public holidays or other circumstances outside our reasonable control.

Orders containing multiple products may be shipped in separate packages and arrive on different dates without additional shipping charges.

Customers are responsible for providing a complete and accurate delivery address. Please contact us promptly if an address needs to be corrected. We cannot guarantee changes after an order has entered production or processing.

Customs duties or import charges may apply depending on the destination. If they are not collected at checkout, the recipient may be responsible for paying them upon import or delivery.

SECTION 5 – RETURNS, REFUNDS AND WITHDRAWAL RIGHTS

Returns, refunds, exchanges, damaged products and cancellation rights are governed by our Return and Refund Policy:

Eligible returns may be requested within 30 days after receiving the order. Items must generally be unworn, unused and returned with their original tags and packaging.

Customers in the European Union retain their legal right to withdraw from eligible online purchases within 14 days after receiving the goods, together with all other mandatory consumer rights.

Personalized or clearly customized products may not be eligible for change-of-mind returns unless they are defective, damaged or incorrect.

Customers must contact info@hasakura.com before returning a product. The registered business address is not a customer return address. We will provide the appropriate return instructions and return address after reviewing the request.

SECTION 6 – THIRD-PARTY SERVICES AND SHOPIFY

Our website may contain links to third-party websites or provide access to services operated by third parties. Those websites and services are governed by their own terms and privacy policies.

Hasakura is not responsible for purchases made independently through an unrelated third-party website.

Complaints regarding products purchased from Hasakura must be directed to Hasakura, even where production, fulfilment or delivery is performed by a service provider.

Shopify provides the ecommerce infrastructure used by this store but is not the seller of products purchased from Hasakura.

SECTION 7 – INTELLECTUAL PROPERTY

Website content, including text, graphics, photographs, product presentations and original design elements, is owned by or licensed to H.M.A. LTD and may be protected by copyright, trademark and other applicable intellectual property laws.

HASAKURA is a registered word trademark owned by H.M.A. LTD (Х.М.А ЕООД) and registered with the Patent Office of the Republic of Bulgaria under registration number 180117.

You may use the website for personal and non-commercial purposes. You must not reproduce, distribute, modify or commercially exploit protected website content without prior written permission, except where permitted by applicable law.

Third-party names, trademarks and content remain the property of their respective owners.

SECTION 8 – WEBSITE AVAILABILITY AND LIABILITY

We take reasonable steps to keep the website and its information accurate, secure and available. However, we cannot guarantee that access will always be uninterrupted or error-free.

We may correct typographical errors, inaccurate product information, pricing errors or availability information when reasonably necessary. If an affected order is cancelled after payment has been collected, the relevant amount will be refunded.

Nothing in these Terms excludes or limits liability where doing so is prohibited by law, including liability for fraud, wilful misconduct, gross negligence, defective or non-conforming goods or breach of mandatory consumer rights.

To the extent permitted by law, Hasakura will not be responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was formed.

Your rights to a refund, repair, replacement, price reduction or other remedy under applicable consumer law are not affected.

These Terms are governed by the laws of the Republic of Bulgaria.

Consumers residing in the European Union or another jurisdiction with mandatory consumer-protection laws retain the protections granted by the mandatory laws of their country of residence.

Nothing in these Terms restricts a consumer’s right to bring a claim before a court having jurisdiction under applicable consumer law.

For disputes that do not involve consumers, the competent courts of Plovdiv, Bulgaria will have jurisdiction.

SECTION 11 – CHANGES TO THESE TERMS

We may update these Terms when reasonably necessary to reflect changes to our Services, business operations or applicable law.

The current version will be published on this page. Changes will not retroactively reduce rights arising from an order placed before the updated Terms took effect.
